Lavorare da freelance per piccoli e grandi editori. Lavorare ma… non venire pagati. O venire pagati con tempi lunghissimi di attesa.
Per aiutare i giornalisti autonomi che si trovano in queste difficili situazioni, spesso anche per poche centinaia di euro, l’Associazione lancia il patrocinio gratuito per le pratiche di recupero crediti.
In sintesi: l’ALG ha stipulato una speciale convenzione con lo studio dell’avv. Andrea Ottolini (partner della Lombarda nei servizi legali) che permette agli iscritti di attivare gratuitamente il percorso di recupero crediti da lavoro vantati nei confronti di editori e committenti che non rispettano gli impegni o le scadenze dei pagamenti. “È un nuovo servizio che la Lombarda offre ai propri iscritti i quali, purtroppo, si ritrovano ad avere a che fare con i “furbetti” del settore: soggetti che chiedono ai colleghi di lavorare promettendo un compenso, ma che a volte spariscono, latitano o ritardano nel versare quanto pattuito” spiega il presidente della ALG, Paolo Perucchini.
“Questo non è solo un importante servizio per i colleghi, ma è anche il tentativo di avviare una battaglia di civiltà e moralizzazione nel settore: intervenire su chi sfrutta il lavoro giornalistico non pagando regolarmente. Per il sindacato significa anche combattere contro soggetti inadempienti che rovinano il mercato”.
Ecco di seguito le condizioni della convenzione per il patrocinio gratuito nelle pratiche del recupero crediti. Il servizio è attivo per gli iscritti alla Alg.
• preparazione lettera di messa in mora della società;
• preparazione, deposito e notifica del decreto ingiuntivo emesso nei confronti della società;
• preparazione e notifica dell’atto di precetto e il titolo;
• deposito, in caso di mancato pagamento successivo alla notifica del decreto ingiuntivo, previa valutazione con il giornalista circa le effettive possibilità di recupero della somma, un pignoramento mobiliare (presso il debitore o presso terzi).
• per eventuali procedure esecutive immobiliari o mobiliari oltre il primo pignoramento verrà sottoposto apposito preventivo.
Le spese vive relative alla procedura (eventuali spese postali ove non sia possibile inviare la lettera di messa in mora a mezzo pec, marche da bollo, contributo unificato che va da minimo 21,50 a massimo 118,50 euro a seconda del valore del credito da recuperare) saranno a carico del giornalista, che dovrà anticiparle allo Studio.
Del pari saranno a carico del giornalista i costi per le domiciliazioni presso professionisti nel caso in cui si rendessero necessarie attività di cancelleria ovvero partecipazione a udienze, nel caso di giudizi da promuoversi presso Giudice di Pace o Tribunale diversi dal Giudice di Pace e Tribunale di Milano.
In caso di esito negativo della procedura monitoria (decreto ingiuntivo), o di mancato recupero del credito, nulla sarà dovuto dal giornalista allo studio ad eccezione delle spese vive già anticipate.
In caso di riconoscimento di somme a titolo di spese legali dalla controparte, o a condanna di spese legali all’esito del giudizio monitorio, le stesse saranno corrisposte allo Studio, ovvero il giornalista ne autorizzerà il pagamento direttamente allo Studio ovvero questi si dichiarerà distrattario ai sensi dell’art. 93 c.p.c.
Nel caso in cui la società debitrice proponga opposizione a decreto ingiuntivo e si instauri conseguentemente un giudizio ordinario, ovvero in caso di opposizione all’esecuzione o agli atti esecutivi, ove il giornalista intenda costituirsi in giudizio, lo Studio applicherà le tariffe agevolate previste dal Regolamento dell’Ufficio Legale ALG.

Grazie per lo stimolo e l’occasione per una breve riflessione rispetto a critiche – sempre legittime –, ma anche ad alcune imprecisioni. L’arrivare “tardi” nelle risposte ai bisogni è sempre opinabile: i bisogni sono tanti, si modificano in continuazione, crescono a seconda delle stagioni. L’arrivare “tardi” è la giusta critica ad una organizzazione che ha fatto e continua a fare “salti mortali” per essere sempre più efficace ed efficiente. Penso, infatti, si possa dare atto dei cambiamenti che la Lombarda ha fatto negli ultimi anni. Dobbiamo essere ancor più efficienti e vicini alle persone: è chiaro, continueremo ad impegnarci a farlo.
È un giudizio ingeneroso, invece, sostenere che i colleghi, autonomi compresi, siano stati lasciati soli. Ingeneroso e non corretto. Il sindacato in questi anni (pandemia compresa) non si è mai sottratto un giorno all’aiuto delle persone. E le forme sono le più varie: servizi, convenzioni, consulenze, fondi di solidarietà. Iniziative speciali ad hoc.
Se il problema è il “patrocinio gratuito”, beh, intendiamoci: la gratuità ha comunque un costo. Se lo sobbarca chi offre il servizio (ovvero la Lombarda). Ma lo si ricordi bene: il sindacato non è “ricco”, per grazia divina. Non dispone di regalie che giungono da qualche zio d’America. Anzi, giusto il 2022 è un anno di grandi cambiamenti per la struttura sindacale dei giornalisti.
Fare un passo come quello intrapreso è un impegno non di poco conto. Ci stiamo provando, la speranza è essere in qualche modo d’aiuto. Speriamo che i colleghi, alla fine, apprezzino quanto proposto.
